(ASdN) – Has Facebook failed in its obligations? The Data Protection Commission (DPC), the Irish equivalent of the National Data Protection Commission (CNPD), will attempt to answer this question. The investigation, announced Wednesday in a press release, will aim to determine the responsibility of the American giant in this affair.

Because for the DPC, it is possible that there could have been an infringement of the general data protection regulation (GDPR) of the European Union (EU), when this leak was discovered in 2019. The social network does not. did not contact the users concerned by the publication of this data, considering that this information was public and had not been obtained through hacking of its services.

Entered into force in 2018, the general regulation of the RGPD however requires companies that notice personal data breaches to report them within 72 hours. An obligation under penalty of financial penalties of up to 20 million euros, or 4% of the company’s turnover in the year preceding the fine.

As a reminder, a file containing information on 533 million social network accounts was released on April 3. Among them, telephone numbers, marital status and professional activity. In Luxembourg, nearly 188,000 accounts have been hacked in this way.

These leaks would nevertheless have been the result of “malicious actors”, Facebook explained last week. Since then, the problem has been resolved according to the American giant, which urges its members to better protect their accounts.
